Privacy Policy

1. INTRODUCTION

The shop being operated by the Tomioka Silk Promotion Organization (hereinafter referred to as the “Shop”) may obtain from its customers their personal information (as defined in Article 2 (1) of the Act on the Protection of Personal Information (hereinafter referred to as the “Personal Information Protection Act”) and other information relating to the customers as individuals (hereinafter referred to as the “Customer Information”) in connection with their use of the Shop. The Shop must comply with the Personal Information Protection Act and other applicable laws and guidelines as well as this privacy policy (hereinafter referred to as the “Privacy Policy”) that is the Shop’s own as set forth hereinbelow in connection with its handling of the Customer Information.

2. SCOPE OF APPLICATION

This Privacy Policy applies to all Customer Information that is obtained by the Shop in connection with the customers’use of the Shop.

3. TYPES OF CUSTOMER INFORMATION THAT THE SHOP MAY OBTAIN

The Shop may obtain the types of Customer Information as set forth below mainly using the following methods: a. method where the customers directly provide their Customer Information by entering it on their devices, etc. through any service linked to the Shop; b. method where the customers provide their Customer Information to the Shop by email, postal mail, in wiring, over the phone, etc.; and c. method where the Customer Information is gathered by the Shop as the customers use any service linked to the Shop or view any information related to the Shop, etc.

INFORMATION THAT THE SHOP MAY OBTAIN AS THE CUSTOMERS PURCHASE MERCHANDISE, ETC.

  • ・Basic information such as the customers’ names, addresses, occupations, etc.
  • ・The customers’ contact information such as their phone numbers, email addresses, etc.
  • ・The customers’ bank account information, etc.
  • ・Other information related to the customers and their merchandise purchases, etc.

OTHER INFORMATION THAT THE SHOP MAY OBTAIN IN CONNECTION WITH THE CUSTOMERS’ USE OF THE SHOP

  • ・Information on the merchandise purchased by the customers and other information related to the customers’ use of the Shop
  • ・Information on the status of the customers’ payments at the Shop
  • ・Information on the customers’ accesses to the Shop including the cookies related to the customers’ use of the Shop, their IP addresses, types of devices being used, mobile device identifiers, types of browsers being used, browser languages, referring URLs, types of platforms being used, number of pages viewed, page viewing time, and date/time records relating to the customers’ activities on the Shop app or website

INFORMATION THAT THE SHOP MAY OBTAIN FROM THE CUSTOMERS THROUGH QUESTIONNAIRE SURVEYS

  • ・Information on the status of the customers’ use of the Shop, any requests, etc. that the customers may have for the Shop, and other information provided by the customers in their responses to the Shop’s questionnaire surveys

4. INTENDED PURPOSES OF USE

The Shop may use the Customer Information as set forth in 3. above for the following purposes.

PROVISION OF SERVICES, ETC. TO THE CUSTOMERS THAT ARE RELATED TO THE SHOP

  • ・Confirmation of the customers’ purchases, etc. of merchandise, etc. using the Shop
  • ・Billing, payment processing, and confirmation of billing and payment information as they relate to the Shop
  • ・Other actions necessary for the provision of services to the customers that are related to the Shop

IMPROVEMENT OF EXISTING SERVICES AND PLANNING OF NEW SERVICES, ETC. RELATED TO THE SHOP

  • ・Investigation and analysis of the status, characteristics, and other attributes of the customers’ use of the Shop
  • ・Questionnaire surveys of the customers relating to the Shop

  • ・Customization of services related to the Shop to the customers’ individual preferences, etc.

PROVISION OF INFORMATION ON SERVICES RELATED TO THE SHOP, HANDLING OF INQUIRIES, ETC. FROM THE CUSTOMERS

  • ・Provision of notifications and information on services related to the Shop
  • ・Confirmation of subscription to email newsletters, and other similar services and email transmissions related to such services
  • ・Provision of information on promotion campaigns, etc.
  • ・Shipment of prizes, etc. in opted-in sweepstakes, etc.
  • ・Provision of information on new products, services, etc.
  • ・Notification of important changes made to the terms of use or services related to the Shop

  • ・Distributing, displaying, and measuring the effectiveness of advertisements related to the Shop
  • ・Implementation of other measures related to advertising and marketing

ADMINISTRATION, OPERATION, ETC.

  • ・Confirmation of the status of the customers’ use of services related to the Shop and their registered information
  • ・Confirmation on the status of the customers’ compliance with the applicable terms
  • ・Handling of instances where there are confirmed or alleged violations of the applicable terms by customers, and resolution of other disputes, etc. related to the Shop’s operation
  • ・Implementation of other measures that are necessary for ensuring the customers’ safety in connection with their use of the Shop and for maintaining the quality of services related to the Shop

5. DEPOSITING AND PROVISION OF CUSTOMER INFORMATION TO THIRD PARTIES

The Shop may provide the Customer Information to a third party or leave it in the custody of a third party in the circumstances as set forth below. In each of such circumstances, the Shop shall screen the third party as needed to make sure it meets the standard as specified by the Shop before depositing or providing the Customer Information to the third party under the Shop’s proper supervision. In addition, the Shop shall make sure that the contract it executes with each such third party includes provisions that require it to properly manage the Customer Information.

DEPOSITING AND PROVISION OF CUSTOMER INFORMATION TO CONTRACTORS

This type of circumstance is where the Shop contracts a private enterprise to outsource to it all or part of the operational tasks of Customer Information processing, provision of information to the customers, operation of promotion campaigns or questionnaire surveys, investigation or analysis of the status of the customers’ use of services related to the Shop, etc.

DEPOSITION AND PROVISION OF CUSTOMER INFORMATION TO THE SHOP’S COOPERATING OR PARTNERING ENTITIES

This type of circumstance is where the Shop engages in a cooperating or partnering arrangement with a private enterprise, etc. in order to provide services related to the Shop (including such cooperating or partnering arrangements with an advertisement distribution service company, advertising agency, or other type of advertising service provider to distribute, display, or measure the effectiveness of advertisements for the Shop).

PROVISION OF CUSTOMER INFORMATION TO A BUSINESS SUCCESSOR, ETC. IN THE EVENT OF BUSINESS SUCCESSION, ETC.

This type of circumstance is where the Shop is involved in a merger, company split, business transfer, or other similar event wherein its business including related services are succeeded by a private enterprise (including a circumstance where the Shop sets up another corporation to have it succeed the Shop’s business).

PROVISION OF CUSTOMER INFORMATION PURSUANT TO LAW, ETC.

This type of circumstance is where the Shop is required to provide the Customer Information to a court, administrative body, competent government agency, or other public institution by law.

RESOLUTION OF DISPUTES WITH THIRD PARTIES

This type of circumstance is where the Shop determines it is necessary to provide the Customer Information for resolving a dispute with a third party or for protecting the rights or interests of the customers or third parties in connection with any service related to the Shop.

6. MANAGEMENT

The Shop shall strive to carefully manage the Customer Information so that it will not be lost, impaired, altered, accessed without proper authorization, leaked, or otherwise compromised. For this purpose, the Shop may hire a private enterprise, etc. and outsource to it the handling of the Customer Information as set forth in 5. above, in which case the Shop shall properly supervise the private enterprise, etc.

7. USE OF GOOGLE ANALYTICS AND COOKIES

USE OF GOOGLE ANALYTICS

The Shop uses Google Analytics in connection with its related services to investigate and analyze the status and characteristics of the customers’ use of the services. The data that are gathered using Google Analytics will be managed pursuant to the privacy policy of Google LLC, etc. To learn more about Google Analytics or how to opt out of it, please refer to their webpages entitled Google Analytics Terms of Service and How Google uses information from sites or apps that use our services.

USE OF COOKIES

The Shop may use cookies and other similar technologies in connection with its related services to improve the services, analyze related statistical data and also to distribute and display advertisements for the Shop, and measure the effectiveness of such advertisements, etc.
Cookies are text data files that get stored on each customer’s device as it accesses any service related to the Shop. Cookies do not contain any personal information related to the customers such as their names, email addresses, etc.
While each customer may decide to limit his or her acceptance of cookies or refuse to accept them entirely at his or her discretion by changing his or her browser settings, etc., such a decision may prevent him or her from normally using the services related to the Shop.

8. CORRECTION OF CUSTOMER INFORMATION BY THE SHOP

If changes occur to a customer’s registered information, the accuracy of which is crucial for billing or payment processing purposes, and which includes without limitation the name of the municipality where the customer resides or his or her postal code, the name of the bank used by the customer, etc., the Shop may update the customer’s registered information to reflect the changes.

9. VERIFICATION AND CORRECTION OF CUSTOMER INFORMATION BY CUSTOMERS, AND DISCLOSURE, ETC. OF PERSONAL DATA IN THE SHOP’S POSSESSION

Each customer may take any of the following actions concerning the handling of his or her Customer Information by the Shop.

VERIFICATION AND CORRECTION OF CUSTOMER INFORMATION

Each customer may at any time file a request to verify and correct his or her Customer Information that is registered with the Shop.

DISCLOSURE OF PERSONAL DATA IN THE SHOP’S POSSESSION

If a customer files a request with the Shop to disclose information on the customer’s personal data being held in the Shop’s possession or a record of provision of such data to any third parties, the Shop shall make the disclosure to the customer as requested except in the following cases:

  • ・if the disclosure could possibly harm the life, body, property, rights, or interests of the customer or a third party;
  • ・if the disclosure could possibly cause significant disruption to the Shop’s normal operation; or
  • ・if the disclosure constitutes a statutory violation.

CORRECTION OF PERSONAL DATA IN THE SHOP’S POSSESSION

If a customer files a request with the Shop to correct, add to, delete, erase, suspend use of, cease provision to third parties of, or take any other action concerning his or her personal data being held in the Shop’s possession, the Shop shall handle the request in compliance with the applicable laws after investigating and verifying that the request is indeed made by the customer himself or herself or his or her duly authorized agent and that the request meets the criteria as specified by the applicable laws. In this connection, please be advised in advance that there could be instances where the Shop might not be able to respond to such customer requests directly due to technical constraints, etc.

10. DISCLAIMERS AND PRECAUTIONS

USE OF WEBSITES OPERATED BY OTHER BUSINESS OPERATORS, ETC.

The Shop shall be exempted from all responsibility for protecting the customers’ personal information, etc. at other business operators’ or individuals’ websites (including the websites hyperlinked from any website being used by the Shop to provide any service related to the Shop). Therefore, each customer is advised to carefully inspect any of the aforementioned websites before using them on his or her own responsibility.

INFORMATION FOR IDENTITY AUTHENTICATION

Each customer is advised to carefully manage the information that is used to authenticate his or her identity so that it does not get lost, forgotten, or unintentionally leaked to a third party.

11. MODIFICATION OF PRIVACY POLICY AND REVIEW OF ITS LATEST VERSION

The Shop reserves the right to modify this Privacy Policy from time to time as needed.
Therefore, each customer is advised to check the latest version of the Privacy Policy as he or she uses any service related to the Shop.
Each time it intends to modify this Privacy Policy, the Shop shall individually notify or publicly announce the information to the customers, including the fact of the Privacy Policy modification, what the modification is, and the date on which the modification comes into effect. In this connection, if the Shop intends to make a modification to this Privacy Policy that requires the customers’ consent under the law, the Shop shall obtain the customers’ consent to the modification of the Privacy Policy accordingly (including instances where the customers are deemed to have consented to the implementation of the modified Privacy Policy by using the Shop after being informed of the modification by individual notification or publication, or by failing to cancel their registered account at the Shop or following any other particular procedure within the period as specified by the Shop).

12. INFORMATION RELATED TO THE SHOP AND INQUIRIES

If you wish to send an inquiry to the Shop concerning this Privacy Policy or file any type of request with the Shop pursuant to this Privacy Policy or the Personal Information Protection Act, please use the inquiry form that is provided by the Shop.
